These Terms of Service ("Terms") govern your access to and use of the Albuquerque Pallets website (albuquerquepallets.com) and the pallet products and services we offer. By accessing the Site or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

1. Products and Services

Albuquerque Pallets provides pallet buying, selling, recycling, repair, custom manufacturing, and transportation services. Our product offerings include new pallets, used and recycled pallets, custom-sized pallets, pallet accessories, and pallet furniture.

All products and services are subject to availability. We reserve the right to modify, discontinue, or update any product or service at any time without prior notice. Product descriptions, images, and specifications on the Site are provided for informational purposes and may vary from actual products due to the nature of reclaimed and recycled wood materials.

2. Quotes and Pricing

Prices quoted through our website, email, or other communications are estimates based on the information you provide. Final pricing may vary depending on:

• Actual quantity and condition of pallets upon inspection
• Product grade and specifications confirmed at time of order
• Delivery distance and accessibility of the delivery location
• Current market conditions and lumber pricing
• Custom fabrication requirements

Quotes are valid for 14 days from the date of issue unless otherwise stated. We reserve the right to adjust pricing for orders not confirmed within this period.

3. Payment Terms

The following payment terms apply to all transactions:

• New customers: Payment is due in full prior to delivery or pickup unless credit terms have been arranged in writing
• Established accounts: Net 30 payment terms may be extended at our discretion after credit review and approval
• Accepted methods: We accept checks, ACH transfers, wire transfers, and major credit cards
• Late payments: Invoices not paid within the agreed terms may be subject to a late payment fee of 1.5% per month on the outstanding balance
• Pallet buyback: Payment for pallets we purchase from you will be issued within 7 business days of receiving and inspecting the pallets

4. Delivery Terms

Albuquerque Pallets provides delivery and pickup services throughout the greater Albuquerque metropolitan area and across New Mexico. The following terms apply:

• Delivery dates and times are estimates and not guaranteed. We will make reasonable efforts to meet scheduled delivery windows
• Delivery fees are based on distance, volume, and accessibility. Fees are quoted separately and added to the product price
• The customer is responsible for ensuring that the delivery location is accessible by our trucks and that there is adequate space for unloading
• Risk of loss transfers to the customer upon delivery of the pallets to the agreed-upon location
• The customer must inspect all pallets upon delivery and report any damage or discrepancies within 24 hours
• Minimum order quantities may apply for delivery. Orders below the minimum may be subject to a small-order surcharge or require customer pickup

5. Product Warranties

We stand behind the quality of our products with the following warranties:

• New pallets: Warranted to be free from defects in materials and workmanship at the time of delivery. New pallets are built to the specifications agreed upon in your order
• Used / recycled pallets: Sold by grade (A, B, or C) and warranted to meet the condition standards for the purchased grade at the time of delivery. Used pallets are sold "as-is" within their grade classification
• Repaired pallets: Warranted to be structurally sound and functional at the time of delivery. Repairs are performed using quality replacement lumber and fasteners
• Custom pallets: Warranted to meet the agreed-upon specifications and dimensions at the time of delivery
• Heat-treated pallets: Warranted to comply with ISPM-15 international phytosanitary standards and accompanied by the appropriate stamp and certification

All warranties are limited to replacement or credit for defective products. Warranty claims must be submitted within 7 days of delivery by contacting us at info@albuquerquepallets.com.

6. Returns and Refunds

Due to the nature of pallet products, our return policy is as follows:

• Returns are accepted within 7 days of delivery for products that do not match the ordered specifications or grade
• Returned pallets must be in the same condition as delivered, unused, and unmodified
• Custom-manufactured pallets are non-returnable unless they fail to meet the agreed-upon specifications
• Return shipping or pickup costs are the responsibility of Albuquerque Pallets when the return is due to our error
• Refunds or credits will be processed within 10 business days of receiving and inspecting the returned products
• Pallet furniture is custom-made and non-refundable once fabrication has begun, unless defective

7. Limitation of Liability

To the fullest extent permitted by law:

• Albuquerque Pallets shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or services
• Our total liability for any claim arising from a transaction shall not exceed the amount paid by you for the specific products or services giving rise to the claim
• We are not responsible for any damage, injury, or loss caused by the misuse, improper storage, overloading, or modification of our pallet products
• We are not liable for delays in delivery caused by weather, traffic, vehicle breakdown, natural disasters, or other circumstances beyond our reasonable control

8. Indemnification

You agree to indemnify, defend, and hold harmless Albuquerque Pallets, its owners, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your use of our products, services, or website, or your violation of these Terms.

9. Intellectual Property

All content on the Site, including text, images, graphics, logos, icons, and software, is the property of Albuquerque Pallets or its content providers and is protected by copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

10. Website Use

By using this Site, you agree not to:

• Use the Site for any unlawful purpose or in violation of any local, state, or federal law
• Submit false, misleading, or fraudulent information through any form on the Site
• Attempt to gain unauthorized access to any part of the Site or its servers
• Use automated tools, bots, or scripts to scrape, crawl, or extract data from the Site
• Interfere with or disrupt the operation of the Site or servers

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Bernalillo County, New Mexico.

12. Modifications to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the revised Terms on this page. Your continued use of the Site or our services after any modifications constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.

13. Severability

If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
